Aún Más Escrutinio para las Visas H-1B: Visitas al Sitio de Trabajo

El continuo escrutinio de la administración de los trabajadores profesionales con Visas H-1B se hizo aún más intenso la semana pasada cuando el Departamento de Seguridad Nacional (DHS) de los Estados Unidos publicó un informe en el que se solicitaban mejoras en el sitio de trabajo para “Administrative Site Visit and Verification Program.” This comes on the heels of the massive number of Request for Evidence (RFE) letters that challenged employers to document the Level 1 wage requested in many H-1B applications and additional proof of the professional nature of the job. The new report signals more frequent and intensive worksite inspections by the Fraud Detection and National Security (FDNS) Unit which has been conducting random inspections for years. FDNS inspectors may arrive at H-1B employee offices without prior notice. To prepare for these visits, employers should do the following:

  • Prepare the HR Department by identifying and reviewing all H1B employees including:
    • Job Titles
    • Job Duties as described in applications
    • Salary
    • Educational and Experience background
  • Make sure to verify the credentials of any inspector, including names and contact information. Inspectors should readily provide business cards
